The following Statement of Privacy (“the Policy”) governs the Akshaya Technologies (“Akshaya,  we, us, our”) website and describes our data collection usage when visiting our website at, when contacting us, when using your (“your, you, user”) login and/or profile for  purposes of doing business with us and/or as a potential buyer. By using Akshaya Technologies’  website, you consent and agree to the data and privacy practices described herein. Akshaya is  committed to protecting and respecting your privacy while developing technology that will allow  you to have the greatest most efficient yet safe online experience possible. Akshaya is one of the  world’s first NFT Marketplaces that provides the greatest physical and experiential shopping  experience in the virtual world. Akshaya’s marketplace powered by deep technology enables  brands, iconic celebrities and content creators to market their products as PHYGITAL NFTs  (Digital + Physical asset). This enables buyers to transact Physical asset with Digital Twins. We  allow end users to view our marketplace and transact on Ethereum block chains.  


A. Data Collection

Akshaya Technologies collect data in order to enable the best experience for users. Some of this  information is provided to us by you directly, such as when you register to use our marketplace,  make an enquiry through our website, contact us for support, or contact us as a prospective user,  partner or consultant. Some information is obtained by analyzing how you interact with our  website i.e. cookies. We also obtain and process data in the context of making digital twin available  to you. We may collect personally identifiable information such as but not limited to the following:  e-mail address, name, home or work address, telephone number, how you/your device interacts  with our web site and marketplace, blockchain address, preferred currency and Metamask wallet  address. Akshaya may also automatically collect information about your computer hardware and  software. This information can include: your IP address, browser type, operating system, referring  URLs, domain names, access times and referring Web site addresses. This information is used by  us for the operation of the service, to maintain quality of service, and to provide general statistics  regarding use of our web site. Please be advised that the direct sharing of personally sensitive or  identifiable information on or through our public forum or message boards may be collected or  used by others. We will not be responsible for privacy statements or policies for websites or  companies outside of Akshaya Technologies or our network of websites and services.

You have the right to choose the type of data that we collect. When you are asked to provide  personal data, you have the right and option to decline. If, however, you choose not to provide data  that is necessary to create an account, you may not be permitted access to our marketplace. The

data we collect is contingent upon the context of your interaction(s) with Akshaya Technologies as well as your privacy settings.

This  data is used to deliver customized content and to advertise to users whose patterns indicate that  they may be interested in a more focused, specialized or particular subject area or topic.

Akshaya Technologies may disclose your personal information, without notice, only if required to  do so by law or in the good faith belief that such action is absolutely necessary to: (a) conform to  the edicts of the law or to comply with legal process including but not limited to subpoenas and/or  warrants served on Akshaya Technologies and any of our websites and/or platforms; (b) in  connection with a legal investigation (c) in order to protect and/or defend the rights or property of  Akshaya Technologies; and, (d) to act under exigent circumstances for purposes of protecting the  personal safety of users of Akshaya Technology, or the public at large; (e) to investigate or assist  in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of  Service.

We use data to provide the best marketplace to you, to improve the experience, and to perform  necessary business operations. This includes operating the marketplace, maintaining and  improving the performance, developing new features, conducting research, and providing  customer support. Examples of such uses may include but is not limited to the following:

Marketplace: We may use data to carry out your transactions with us and to make the marketplace available to you. In certain instances, we may include personalized features and recommendations that can help tailor a personal experience based on the information you’ve provided.

Technical support: We may use data to troubleshoot problems and to provide excellent customer  care and support services.

Feature Releases: We use data to continually improve our website and provide the very best  features available for upcoming releases, including system administration and system security.

In order to utilize our Service(s), you must use a third-party wallet which allows you to engage in  transactions on public blockchains. Your interactions with any third-party wallet provider are  governed by the applicable terms of service and privacy policy of that third party.


If you are a non-U.S. user of our service(s), you acknowledge and agree that by visiting our site(s)  and providing personal data, you’ve acquiesced in your personal data being used and processed  for any and all purposes described in the Privacy Policy. In addition, your personal data may be  processed in the country in which it was collected and in other countries, including but not limited  to the United States, where laws regarding processing of Personal Data may be less stringent than  the laws in your country. We implement a variety of measures to ensure that our processing system(s) remain confidential,  resilient, and available. Specifically, we have implemented processes to help ensure high  availability, business continuity, and prompt disaster recovery. We commit to maintaining strong  physical and logical access controls and we engage with our cloud maintenance partners to identify  and address potential vulnerabilities.

High Availability. Our marketplace utilizes properly-provisioned, redundant servers (e.g.,  multiple load balancers, web servers, replica databases) in case of failure.

Business Continuity. We keep encrypted backups of data daily in multiple regions on Amazon  Web Services Platform. While never expected, in the case of production data loss (i.e., primary  data stores loss), we will restore organizational data from these backups.

Disaster Recovery. In the event of a region-wide outage, we will bring up a duplicate environment  in a different AWS Platform region. Our operations team has extensive experience performing full  region migrations.

Physical Access Controls. Akshaya is hosted on Amazon Web Services Platform. AWS features a layered security model, including extensive safeguards such as custom-designed electronic  access cards, alarms, vehicle access barriers, perimeter fencing, metal detectors, and biometrics.  According to the AWS Security Whitepaper: “AWS’s data centers are state of the art, utilizing  innovative architectural and engineering approaches. Amazon has many years of experience in

designing, constructing, and operating large-scale data centers. This experience has been applied  to the AWS platform and infrastructure. AWS data centers are housed in nondescript facilities.  Physical access is strictly controlled both at the perimeter and at building ingress points by  professional security staff utilizing video surveillance, intrusion detection systems, and other  electronic means. Authorized staff must pass two-factor authentication a minimum of two times  to access data center floors. All visitors and contractors are required to present identification and  are signed in and continually escorted by authorized staff.” Akshaya employees do not have  physical access to AWS data centers, servers, network equipment, or storage.

Logical Access Controls. Akshaya works with our Cloud Platform Service partner Everest with  an assigned administrator of its infrastructure on AWS Platform, and only designated authorized  Everest and Akshaya operations team members have access to configure the infrastructure on an  as-needed basis behind a two-factor authenticated virtual private network. Specific private keys  are required for individual servers, and keys are stored in a secure and encrypted location.


A. Summary

You can view, access, edit, delete, or request a copy of your personal data for many aspects in our  marketplace via your user dashboard. You can always choose whether you want to receive  marketing communications from us. You can also opt out of receiving marketing communications  from us by using the opt-out link on the communication, or by visiting your user dashboard.


Data Access. You can access your personal data on your account’s user dashboard.

Data Portability. You can request a copy of your personal data by submitting an email to us  at and including “Please send me a copy of my personal data” in the  “Subject” line. Akshaya will verify your ability to access that email, then send you a digital export  of the data we hold that is associated with your email address. We will use reasonable efforts to  respond to your request within 30 days of receipt of the request. Akshaya may be limited in its  ability to send certain personal data to you (e.g., the identification of your Metamask wallet).

Data Erasure. You can delete your personal data on your account’s user dashboard. Please be  aware that we require certain information about you in order to make the Akshaya marketplace available to you; this means that if you want to delete any of these critical pieces of personal data,  you may be required to delete your entire profile and no longer be able to access or have access to  artifacts. Alternatively, you may request that Akshaya delete your personal data by submitting an  email to us at and including “Please delete my personal data” in the  “Subject” line. Akshaya will verify your ability to access that email, then delete the personal data  associated with your email address. We will use reasonable efforts to respond to your request  within 30 days of our receipt of the request.

Data Correction. You can modify your personal data on your account’s user dashboard. Note that  since some of the data we collect is specific to you – for example, your Metamask wallet address.  You may not be able to modify this data without needing to create a new user profile.

Your Communication Preferences. You can choose whether you wish to receive marketing  communications from us. If you receive marketing communications from us and would like to opt  out, you can do so by following the directions in that communication.


Occasionally, at our discretion, we may include or offer third party products or services on our  website or through our Akshaya marketplace. If you access other websites using the links provided,  the operators of these websites may collect information from you that will be used by them in  accordance with their privacy policies. These third party sites have separate and independent  privacy policies. We, therefore, have no responsibility or liability for the content and activities of  these linked sites.
